We have not sold or shared Personal Information collected from you in the last twelve (12) months and we will not sell or share the same in the future.

We have not collected any Sensitive Personal Information from you in the last twelve (12) months and we will not collect the same in the future.

We will not discriminate against California residents for exercising any of their rights under the CCPA. Moreover, unless permitted by the CCPA, we will not:

Charge you different prices or rates for goods or services, including by granting discounts or imposing penalties;
Provide you with a different level or quality of goods or services;
Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services; or
Retaliate against our employees, applicants for employment, or independent contractors.

(7) Exercising Your Rights for a Disclosure Request, Deletion Request or Correction Request, etc.

To exercise your rights for a disclosure request, deletion request or correction request, etc. described above, please submit a verifiable request to us by contacting us by using the contact channels set forth in “7. Only you, a natural person or a person registered with the California Secretary of State that you authorize to act on your behalf, or a person who has a power of attorney or is acting as a conservator for you, may make a verifiable request related to your Personal Information. Appendix — International Privacy Policy

Visional Pop, Inc. collects, uses, and discloses personal information (the “Personal Information”) both inside and outside of California, the United States. In order to protect Personal Information of data subjects outside of California, we have established this International Privacy Policy (this “International Privacy Policy”). This International Privacy Policy applies to any and all of our processing of Personal Information obtained from data subjects located outside of California.

In the processing of the Personal Information, we will comply with this International Privacy Policy, and the laws and regulations applicable to our processing of the Personal Information (the “Applicable Laws”).

If, at Visional Pop’s request, you send certain specific submissions (for example, contest entries) or, without Visional Pop’s request, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “Comments”), you agree that Visional Pop and/or its designee may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any Comments that you forward to Visional Pop. You further agree that your Comments will not contain libelous or otherwise unlawful, abusive, or obscene material, nor contain any computer virus or other malware that could in any way affect the operation of the Website, the Store, the Services, or any related website. Your consent to use the Mobile Service is not required as a condition of purchasing any products on the Store. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of the Terms of Service and/or the Agreement.

Visional Pop’s failure to enforce any provision under the Terms of Service or the Agreement or to exercise any rights or remedies under the Terms of Service or the Agreement, or delay in exercising such rights or remedies shall not be interpreted as a waiver of such enforcement of provision nor exercise of rights or remedies by Visional Pop.

SECTION 19 - GOVERNING LAW AND DISPUTE RESOLUTION

The Terms of Service and the Agreement shall be governed by and construed in accordance with the laws of the State of California, U.S.A., without reference to its conflict of laws provisions, and the rights and remedies of the parties shall be determined in accordance with such laws.

Any matter, dispute or controversy between you and Visional Pop arising out of or relating to the Terms of Service or the Agreement shall be exclusively submitted to any federal or state court located in the State of California, U.S.A.
